Exchanging Land for Social Security Basing on “Right over the Property of Another” :An analysis of sociology of law

统筹城乡社会保障体系和推动农村社会健康发展是我国正在推进的社会发展战略。文章以城市化为背景,主张吸取国企改革经验,将"保障"从"土地"中剥离出来,让二者各司其职,通过土地资源的流转整合来发展现代农业,通过社会保障体系的建立来保护农民的合法权益。作者从社会关系对社会法律规范的需求入手,通过分析改革开放以来"人—地关系"变化所带来的新型"地—权关系",推导出"土地换保障"的客观必要性,并从他物权的角度论证其合法性。然后,作者通过借鉴国外的典型经验和总结国内相关工作的得失,描绘了"土地换保障"的逻辑路径并对其具体实践进行了理性探索。 

Overall planning of the Urban and Rural Social Security Sy stem aims to develope the rural society .The article suggests peeling social security off land in order to integrate land resources and develop modern agriculture .The author finds that the Economic System Reform and Urbanization have brought tremendous changes to man-land relationship and land-right relationship in the past 30 years.All these changes need exchanging land for social security , whose legitimacy is based on right over the property of another .Drawing lessons from practices at home and abroad , the paper depicts the logical path of exchanging land for social security and gives some suggestions for it.
