The Instability of Peasants' Land Property Rights :A description of Li village' s history about land property strife , 1867 -2008

 要将地权稳定性的问题操作化是困难的,因为我们没有足够的经验数据进行横向和纵向的广泛对比。本文从逻辑上提出,稳定的地权需要以确定的地权规则为前提,所以,我们可以从地权规则是否确定来接近地权是否稳定这一问题的内核。参与地权界定的规则是多元的,这时,必需一种相对强大的规则具有超越其他规则的力量,否则,规则只能成为主体利用和选择的对象,而不能约束主体。所以,我们假定,在多元规则中存在一个主导性的规则,是地权稳定的必要条件。本文通过对一个村庄自太平天国以来的土地纠纷史的素描和分期来检验这个假定,从中发现多元规则的结构演变,而这个结构演变的实质就是多元规则中的主导性规则的突生、转换和湮灭。 

It is difficult to make a diachronic description on the stability of peasants' land property rights, for we have no available criterion to judge whether the land property rights of one period is more stable than another one. However, maybe we can find great illumination from Zhang Jing ' hypothesis, which interprets the instability of small peasants' land property rights from the perspective of indeterminacy of regulations about land property .Following this approach, the author tries to revise her pessimistic view on Chinese legal system .By describing the history of land property strife from 1867 to 2008 , the author argues that effective land regulation system has been established in rural China , and stable land property rights could be constituted so long as we can establish one dominant regulation firmly among the regulation systems.
