| 摘要： | 作为一种新兴的社会现象,城市业主维权运动主要形成于20世纪90年代中后期,并给中国城市基层社会的政治生态带来重大影响。本文试图基于对城市业主维权抗争实践的观察和研究,提出“法权抗争”这一分析范式,并将之具体化为“上访维权”、“诉讼维权”和“立法维权”三个基本类型；在此分析架构下,本文将为当代中国城市业主维权研究提供一个初步的描述类型学。 |
| 英文摘要： | Urban homeowners’ rights protection movements mainly formed in the middle period of the 1990s, and brought about significant changes for urban local communities’ political ecology. Based on observation and research of urban homeowners’ rights protection activities, this article attempts to construct a new analytic paradigm— legal rights activism, which can be categorized into three levels: resistance with the law, resistance through the law, resistance for the law. Under this analytic framework, the article provides a typology of description for urban homeowners’ rights protection activities in contemporary China. |
